Why Register a Foreign Divorce in Malaysia?
A divorce granted overseas does not automatically take effect in Malaysia. As such, it will not be recognised by the Registrar General at JPN for the purpose of registering the foreign divorce in Malaysia.
Therefore, the foreign divorce order must first be recognised as valid by the Malaysian Court in order to have legal effect here.
Failing to register your foreign divorce can lead to serious legal complications, such as:
- Being considered still legally married under Malaysian law;
- Inability to remarry in Malaysia;
- Inheritance or estate disputes; and
- Issues with property transfer or joint assets.
Therefore, registration ensures that your foreign divorce is legally recognised by Malaysian authorities, particularly by JPN and the Malaysian courts.
How Can A Foreign Divorce Be Recognised In Malaysia?
Pursuant to Section 107(3) of the Law Reform (Marriage and Divorce) Act 1976 (LRA), a foreign divorce order may be registered in Malaysia if the Registrar General is satisfied that the divorce order can be recognised as valid in Malaysia.
In order to get the foreign divorce order recognised in Malaysia, a petition may be filed at the Malaysian High Court for a declaration that the foreign divorce order is valid or for an order to reseal the foreign divorce order in Malaysia.
Once this is done, the foreign divorce order will be recognised in Malaysia and may be registered by JPN.
What Are The Documents Required?
- A copy of the Applicant(s) NRIC/Passport;
- A copy of the Marriage Certificate; and
- A certified true copy of the foreign divorce order.
